Guys. Its me again its like a sunny tuesday which we never get get here. But im coming at you today about sidewalks because people always ask about sun rocks and who owns it who has to maintain it what am i supposed to do we have a lot of trees in portland.
Which is fantastic and theyre often planted in that sidewalk strip between the curb and the sidewalk and often those trees get underneath the sidewalk and then cause damage to the cement make the pieces of sidewalk lift up or crack or break and of course those are tripping hazards. So someone typically trips on your property. Youre liable.
And you have to take care of their health care and sometimes your insurance company will give them a settlement. So of course. Its good to wonder who owns the actual sidewalk.
So of course. The answer is always complicated the sidewalk is owned by you but it is in the citys what right of way so mostly what that means to you is just a person whos trying to take good care of their property. Is that the sidewalk has to be properly maintained and if its not the city is gonna reach out to you and force you to fix it so for instance.
I had a client who had exactly that a tree had lifted up the sidewalk and it had buckled kind of like this and the city sent them a notice that said you have to fix this your neighbor tripped on it and if you dont fix it well fix it for you and then well well attach a lien to your property. How fun is that its not very cheap to maintain that either so in the times of snow. I would make sure that its shoveled or that there salt on that section of your sidewalk.
And what other things the trees obviously you want to make sure theyre maintained and theyre not damaging your your sidewalk and then no obstructions. You know ive had you know my sisters kids playing in the sidewalk and they draw on the sidewalk and then they leave their chalk on the sidewalk. Which again is another tripping hazard.
You might not know this about me. But i used to work for an insurance company and we had plenty of claims where people had fallen on the sidewalk broken their arm. Its a real serious problem.
And then you are actually liable for that its not the city.
